A Home Owners’ Association is required for all apartment buildings.

In spite of the fact that such an Association is customary in most European countries (often it is a legal obligation) starting up such an association in Turkey can be a quite complicated matter.

An overview of the factors to be taken into account:

  1. When an apartment building has been completed and where most of the apartments have been sold, in most cases, the contractor will hire a janitor. The contractor will also determine the amount that home owners need to pay for monthly service charges. Thus the owners have no overview of costs involved and will wonder whether this amount is justified. Moreover nobody has any idea where the money goes or what it is used for. By law a builder needs to withdraw from the project after it has been sold and assure a handover, in consultation with the Home Owners’ Association. In practice this does not always happen.
  2. After purchasing an apartment in a new building the buyer is fully dependent on the contractor until the Home Owners’ Association can be established. Most buyers frequently have no idea that such an Association is obligatory or even possible. As a result a lot of time is wasted (in combination with a lot of irritation) before everything is organised and runs as it should.
  3. When an apartment building is occupied by foreigners, the majority will probably not be residing on a permanent basis. The apartments are frequently used only as a holiday residence. This means all the residents are rarely present at the same time. This also presents an obstacle to forming a Home Owners’ Association.
  4. Different owners with different nationalities. The language barrier often complicates any efficient communication.
